Synopsis: |
Following a by-election in Scotland, the Returning Officer is required to deposit the official election documents with the Sheriff Clerk of the sheriff court district in which the constituency is situated. These documents include all the ballot papers and the marked registers and absent voters lists. The documents from the Glenrothes by-election held on 6 November 2008 were hand-delivered to the Sheriff Clerk by a member of the Returning Officer's staff and a receipt was obtained in accordance with the Parliamentary Election Rules. On 3 February 2009, it came to light that the Sheriff Clerk no longer had the marked registers that were deposited with him, although other election stationery remained in his possession. This protocol specifies the process by which a substitute marked register will be created to replace the lost original. |
