The complaint was that Mr Paisley Jnr had failed to register as an interest the extent of his degree of involvement with Mr Seymour Sweeney; enter in the Register of Members' Interests a shareholding in Ballyallaght Management Ltd; to enter in the Register of Members' Interests the fact that his father in law, Mr James Currie, had become the sole Director of Sarcon 250 Ltd to which he paid rent in respect of his constituency office in Ballymena; and that the amount claimed in rent for the constituency office was excessive. The first two are not upheld (the Committee disagreeing with the Commissioner on the first matter), the third complaint is upheld, whilst on the fourth Mr Paisley Jnr is not found to have broken the rules even though the rent claimed is significantly in excess of what might be regarded as normal market rent. The Interim Commissioner then identified more general issues which relate to the Assembly's rules governing the use of Office Cost Allowance.In particular he recommended that the level of rent claimed for any constituency accommodation should be underpinned either by an independent professional valuation of the premises or should be determined by the Commissioner for Valuation. He also considered the ambiguity concerning the rules prohibiting the use of the Office Cost Allowance to purchase property and the need for clearer rules on the apportionment of costs. The Committee believes that it is essential for the integrity of the Assembly that the rules governing the use of Office Cost Allowance are reviewed urgently to take account of these issues. |
