Synopsis: This book provides a detailed analysis of the landmark decision of Down Lisburn Health & Social Services Trust v H & R. Apart from being the first (and probably the last) appeal in a freeing case from Northern Ireland to go to the House of Lords, the Opinions of Lord Carswell and Lady Hale are of significance to family law practitioners, not only in respect of freeing, but also in relation to the proper approach to be taken to historic breaches of Human Rights by public authorities which become apparent in the course of both care and freeing/adoption proceedings. The purposes of this publication are to explain the circumstances of the case and to explore the implications of both the majority and minority Opinions.
