Description: Part of a series examining the history of crime and justice in America, this volume attempts to provide a history of the reform of the criminal justice system. The contributors assess moral obligations, penal reforms, corporal punishment, education and social control.
Synopsis: The history of the reform of the criminal justice system is easily seen as the history of failure; it helps in evaluating this long history if we think of it as the history of building the system, of forming it. And it tempers the harshness of our evaluations when we consider that the failures of the criminal justice system reflect out dim understanding of humans and how they work. For the larger task of the criminal justice system is to change human behaviour; by implication this requires a fairly deep understanding of that behaviour and of the larger society: simply put, we are not there yet. Most reforms did not accomplish all that the reforms wanted; the ironic tone is all too easily taken by an evaluator of reforms, and we must all be careful in judging the unanticipated outcomes of human actions, for such may be the one theme which underlies history.
